However, if an appeal is the right choice for you, then it is most likely that your UK Spouse Visa Appeal will be based on Article 8 of the European Convention on Human Rights (ECHR).
Article 8 is an individual’s right to respect for their private and family life, their home and their correspondence. A public authority is not allowed to interfere with the exercise of this right unless they decide that it is necessary for public safety or the economic wellbeing of the country. Therefore, during a successful appeal, it must be proven that:

The process to appeal your UK spouse visa refusal
If your UK Spouse Visa application was refused while you were located in the UK, you can challenge the decision within 14 days from the date that the decision was made by directly submitting an appeal to the First Tier Tribunal.
If you are outside of the UK, you have 28 days to appeal. The fees for this process are £80 without a hearing, and £140 with a hearing.
