Overall Purpose of the Role

The role holder will be responsible for a caseload of pre-litigated Housing Disrepair cases and should be able to manage these with confidence and knowledge in line with the Company’s exceptional customer service standards.

Job context

The role of the Housing Legal Advisor – Pre-litigation will demand an excellent understanding of Housing Disrepair claims, including where appropriate some personal injury.

The role holder must have an ability to manage a high workload whilst at the same time have a sound understanding of all aspects of pre-litigated cases and drafting pleadings.

The role holder will be responsible for taking individual responsibility for a caseload of pre-litigated Housing Disrepair files, to include  where appropriate some personal injury.

Principal accountabilities

  • To demonstrate a good understanding of the housing disrepair pre-action protocol
  • To demonstrate a good understanding of the technical issues involved in pursuing a pre-litigated housing disrepair case
  • To have a good working knowledge of housing disrepair, liability and relevant case law
  • To demonstrate the ability to take on individual responsibility within the context of a team environment
  • To demonstrate commercial awareness and a proactive approach to all aspects of work
  • To demonstrate strong decision making skills
  • Be able to achieve targets on a monthly and annual basis that are both monetary and non-monetary and to contribute to the profitability of the team as a whole
  • To demonstrate excellent communication skills including client awareness and client care
  • To demonstrate an ability to manage risk on an individual and team level
  • To operate in line with both internal and external compliance standards
  • Maintain strong relationships with both internal colleagues and external customers and agencies.
  • Ensure all cases are dealt with in compliance with Solicitors’ Accounts Rules and Law Society practice management standards

LEVEL ONE

      • Be able to review and value Surveyor’s reports under supervision
      • Be able to carry out quantum reviews/assessments under supervision and formalise case plans
      • Have some knowledge of the procedures around compliance with the Housing Disrepair Pre-Action Protocol.
      • To take individual responsibility of a caseload up to 100 files 

LEVEL TWO

    • Be able to review and value Surveyor’s reports without supervision
    • Be able to identify the appropriate expert to deal with the issues at hand (e.g. chartered surveyor, heating engineer etc.)
    • Be able to carry out quantum reviews/assessments without supervision and formalise case plans
    • Excellent knowledge of dealing with cases requiring compliance with the Housing Disrepair Pre-Action Protocol and that include complex issues relating to Specific Performance and associated damages claims, together with some personal injury.
    • Excellent knowledge of current case law affecting Housing Disrepair.
    • To take individual responsibility of a caseload up to 100 files

LEVEL ONE

Desirable

  • Some experience of handling housing disrepair cases is desirable but not essential. Such experience could include:
    • An understanding of the Housing Disrepair pre-action protocol
    • Experience of reviewing and valuing surveyor evidence
    • Experience of carrying out quantum reviews/assessments and formalising case plans
  • A working knowledge of PROCLAIM would be an advantage

Essential

  • The ability to run an effective diary system
  • Excellent customer service skills
  • Excellent telephone manner
  • Excellent fact finding skills
  • Assertiveness and a determination to “get things done”
  • Good organisational & interpersonal skills
  • Good oral communication skills

LEVEL TWO

  • Have a proven track record of dealing with Housing Disrepair claims over a period of 3 years or more.
  • Have an excellent understanding of the Housing Disrepair pre-action protocol
  • Excellent understanding of the Civil Procedure Rules
  • Experience of reviewing and valuing surveyor evidence without supervision
  • Experience of carrying out quantum reviews/assessments without supervision
  • The ability to run an effective diary system
  • Excellent customer service skills
  • Excellent telephone manner
  • Excellent fact finding skills
  • Assertiveness and a determination to “get things done”
  • Good organisational & interpersonal skills
  • Good oral communication skills
