Overall Purpose of the Role

The role holder will be responsible for a caseload of pre-litigated personal injury cases and should be able to manage these with confidence and knowledge in line with the Company’s exceptional customer service standards.

Job context

The role of the Legal Advisor – Pre-litigation will demand an excellent understanding of motor claims and personal injury.

The role holder must have an ability to manage a high workload whilst at the same time have a sound understanding of all aspects of pre-litigated cases and drafting pleadings.

The role holder will be responsible for taking individual responsibility for a caseload of pre-litigated Personal Injury files, to include fraud that proceed both in and out of the MOJ portal.

Principal accountabilities

  • To demonstrate a good understanding of the pre-action protocol
  • To demonstrate a good understanding of the technical issues involved in pursuing a pre-litigated case
  • To have a good working knowledge of road traffic accidents, liability and relevant case law
  • To demonstrate the ability to take on individual responsibility within the context of a team environment
  • To demonstrate commercial awareness and a proactive approach to all aspects of work
  • To demonstrate strong decision making skills
  • Be able to achieve targets on a monthly and annual basis that are both monetary and non-monetary and to contribute to the profitability of the team as a whole
  • To demonstrate excellent communication skills including client awareness and client care
  • To demonstrate an ability to manage risk on an individual and team level
  • To operate in line with both internal and external compliance standards
  • Maintain strong relationships with both internal colleagues and external customers and agencies.
  • Ensure all cases are dealt with in compliance with Solicitors’ Accounts Rules and Law Society practice management standards

With for:
LEVEL ONE

  • Be able to review and value GP reports without supervision
  • Be able to deal with cases where more than 1 discipline of medical expert is required
  • Be able to carry out quantum reviews/assessments without supervision and formalise case plans
  • Be able to deal with minor cases proceeding to Infant Approvals without supervision
  • Have a good knowledge of the procedures around cases that are approaching limitation
  • To take individual responsibility of a caseload up to 200 files
  • Good working knowledge of dealing with cases that proceed outside the MOJ portal
  • Good working knowledge of the principles of fraud and LVI allegations
  • Be able to deal with claims proceeding out with the MOJ portal up to the value of £20,000 with supervision

LEVEL TWO

  • Be able to review and value GP reports without supervision
  • Be able to carry out quantum reviews/assessments without supervision and formalise case plans
  • Excellent working knowledge of dealing with cases that proceed outside the MOJ portal
  • Be able to deal with claims proceeding out with the MOJ portal that exceed £20,000 with supervision
  • Proven track record of dealing with cases with allegations of fraud/LVI.
  • Excellent knowledge of current case law affecting fraud/LVI
  • To take individual responsibility of a caseload up to 200 files
