Client Awarded £6,000 for Noise Injury and Tinnitus Claim

Our client submitted a noise injury and tinnitus claim due to the negligence of two of their past employers.
What was the Noise Injury and Tinnitus Claim?
Our client was employed as a Maintenance Fitter for the First Defendant from 1974 to 1979. During that time, he was exposed to noise from the machinery and processes in the workplace which would produce the pipes. The metal press machines, stampers and rollers emitted such noise that meant the Claimant struggled to converse without shouting or using sign language. The client was not provided with any hearing protection during this period of his employment.
Next, the client worked as a Methane Extractor for the National Coal Board from 1980 to 1985 in St Helens. As a result of this, he would be exposed to noise from the machinery such as methane extraction machinery and processes and noise from the coal face itself.
The Client had sustained a noise injury surmountable to 12 dB with mild tinnitus due to the negligence of the Defendant.
What Was the Outcome of the Noise Injury and Tinnitus Claim?
The Second Defendant settled the Claimant’s claim initially at £3,000.00. The matter was then listed for a limitation trial against the First Defendant. The Claimant was successful in defending his claim in the limitation trial and the matter subsequently went on to settle against the Second Defendant.
