What was the Housing Disrepair Claim?
Since the 19th of January 2019, our client has resided at her property where she has been exposed to damp, dust, and mould. Due to prolonged exposure, our client has developed health issues such as a nocturnal wheeze and cough. Due to the negligence of her landlord, she is now reliant on inhalers.
As a result of the pandemic, our client was unable to leave her property. During this time, she felt that her symptoms deteriorated, and she became more reliant on inhalers to assist with her breathing.
Our client has now moved out of the property that originally caused the problem. She has since moved in with her mother-in-law due to her concerns that the property would exacerbate her and her children’s conditions, who are also suffering from breathing problems because of the damp, mould, and dust.
The landlord was aware of the conditions of the property. This was because they had conducted a surveyor’s report at their own request. As a result, an inspection was carried out on the 28th of October 2019. The report followed on the 14th of November 2019.
The report revealed that several rooms were identified as having large amounts of damp in. In addition, the high walls needed work carried out to reduce the damp to a level that was acceptable and would not cause further deterioration of any condition nor any detriment to any tenant’s health.
Difficult Breathing from Mould Resulting in a Housing Disrepair Claim
Our client sought medical intervention in September 2019 after experiencing severe difficulty breathing. Although she now lives in a different building, the symptoms are still problematic but not to the extent when she lived in the problem.
