What was the Leak Damage Claim?

Our client had suffered multiple roof leaks at her property over a 9-year period between 2013 and 2022. The leaks caused substantial damage to her property. This was inclusive of the kitchen, lounge, and bedroom which resulted in damage to her personal belongings. As a result, she enlisted the help of AWH’s Hesham Bilal-Hafiz to make a leak damage claim.

Our solicitors got involved and made the landlord further aware of the roofing issues. The landlord was prompted to book a temporary repair measure to prevent further leak damage. However, when a second major flood happened in September 2021 more water got into the property. By not carrying out measures to fix the roof, the landlord’s negligence caused more damage to the property.

In June 2021 a chartered surveyor received instruction on the matter. They identified £19,440 worth of Actionable Disrepair in his Schedule of Works.

The landlord’s constant neglect of the property issues, for example, the extensive time taken to carry out repairs, and the constant misdiagnosis and negligence left our client extremely stressed and agitated. The landlord’s negligence has caused her significant mental health issues due to the property being in a significantly poor condition. The damage to her property has caused her Asthma and her Gastritis to get considerably worse due to the stress she had been enduring.

Additionally, because our client was that agitated by the Landlord’s conduct, she formally wrote to her local MP in August 2019 to discuss the situation. She also made formal complaints in July 2019 and January 2021 directly to the Landlord’s management teams.

What was the Outcome of the Leak Damage Claim?

With the legal expertise of our housing disrepair solicitor, Hesham Bilal-Hafiz, our client received a £9,500 settlement on the 1st of April 2022. This was inclusive of both general and special damages to reflect the amount of inconvenience she has suffered over the years and cover the cost of her damaged fitted wardrobes. This was inclusive of all the actionable disrepair in the expert surveyor’s report. The landlord is to also replace the flooring and carpets.
