Labourer with Hernia Wins Back Injury Claim

What Was the Back Injury Claim?
Our client was employed as a skilled labourer from April 2017 to July 2019. During his employment, his usual hours were 7:30 am to 5:00 pm, Monday to Friday. During his shift, he had one 30-minute break at 10:00 am plus an additional 30-minute lunch break at 1:00 pm.
His role varied as a labourer. The role included keeping the site clean and tidy, assisting other tradesmen, and taking and storing deliveries including very heavy items. These heavy items included:
- fire doors
- concrete lintels
- steel lintels
- stone windowsills
Some of these items weighed more than 30kg. In addition, assistance from another was given only occasionally but not often.
During his employment, there were never any lifting devices provided.
In addition, our client would have to move heavy items around the site. They were often hauled up only his shoulder to support the weight and for ease of transporting.
Heavy Lifting Resulting in Hernia
In June 2019, our client delivered several metal garage doors. Shortly after he noticed a hernia. The symptoms began as an egg-shaped swelling on his left groin area, which was painful to touch and walk with.
As soon as our client noticed the hernia, he informed the site manager. However, his manager did not give him lighter duties until a few weeks later in July. By this time the injury had become more apparent and severely affected his work.

During his employment, our client was not given any manual handling training. Additionally, he does not recall seeing any risk assessments. He was expected to get the job done regardless of how heavy the items were and lack of mechanical assistance or assistance from others.
