Before an official police interview takes place, you are always entitled to legal advice from a solicitor and you can request that your solicitor is present with you in the interview room when the official interview by the police takes place.

All interviews will be recorded. Depending on the severity of the crime that you are being accused of, the interview may be recorded on either a video or on an audio file. The evidence from this interview may later be used against you in court, so we’d recommend you always seek our legal advice before your official interview takes place.

Whilst you are being interviewed, the police will question you about the crime that you’re suspected of. You don’t have to answer the questions, but there could later face adverse consequences if you do not. For instance, if you remain silent in your interview but then later explain your actions when you are in court, then the judge and jury might ask why you didn’t raise your defence with the police from the start.
