The Equality Act 2010 & Workplace Discrimination

The Equality Act 2010 is in place to protect both employees and applicants from unfair treatment in the workplace.

This Act is one of the most recent and meaningful changes in employment law. Set out by European legislation, it was created to minimise social exclusion, discrimination and inequality.

If your employer breaches the Equality Act by carrying out or condoning discrimination based on one of the ‘protected characteristics’, you can make a claim against them.

The Protected Characteristics

There are several ‘protected characteristics’ listed in the Equality Act 2010 which relate to unlawful discrimination at work. These protected characteristics are:

  • Age
  • Disability
  • Religion, belief, or not following a particular religion or beliefs
  • Race; including colour, nationality, ethnic or national origin
  • Sex; including employment discrimination concerning pregnancy or maternity leave
  • Sexual orientation
  • Gender reassignment
  • Marital status, married, or civil partnership
