Financial Settlement Packages

We offer a range of fixed fee financial packages, so you never run into any unpleasant surprises. The fixed fee services will particularly appeal to those couples who have the desire to settle their financial issues constructively.

To ensure an efficient settlement procedure, couples will benefit from using experienced financial settlement solicitors in order to reach their desired outcome.

Our Financial Settlements Services

  1. Stage 1: Negotiations and disclosure

    At this initial stage we assist our client to compile their financial disclosure to be mutually exchanged with their spouse so that they can reach a legally binding financial agreement.

  2. Stage 2: First Directions Appointment (FDA)

    The FDA stage will only apply where the negotiations and disclosure stage has failed. In this stage financial remedy proceedings need to be issued for the court to determine the financial issues arising from the marriage.

  3. Stage 3: The Financial Dispute Resolution (FDR) hearing

    Matters will only proceed to a financial dispute resolution hearing if matters cannot be agreed through the initial steps of negotiation and FDA. The purpose of the FDR hearing is that you and your former spouse get the opportunity to settle matters by negotiation through advancement of settlement offers.

  4. Stage 4: The Final Hearing

    The final hearing is where control is taken away from each party and where the final decision is made by the judge. Both parties present their case through facts and evidence to this judge, who will then  give judgement as to how the financial assets will be divided.

What Happens at Each Stage of the Financial Settlements Process

If handled appropriately couples will generally not need to complete more than the first stage, in which all settlement terms can be finalised if the couple can come to an agreement.

  • Stage 1: Negotiations and disclosure

    This stage is not voluntary. Both parties need to provide full disclosure if they genuinely wish to reach an agreement quickly and keep costs to a minimum.

    At this stage, we will go through the following steps with you.

    1. Financial statement

      Initial advice on processes and procedures and completion of the financial statement ('Form E')

    2. Disclosure

      Liaise with your spouse in regards to exchange of information and exchange of voluntary disclosures

    3. Negotiation

      Negotiate a settlement and agree on the terms of the consent order

    4. Submission

      Submit the consent order to the court

    5. If no agreement can be reached

      If negotiations fail, advise you on next steps

    Not included in this package

    The following services are not included in this financial settlements package. We do offer these services separately.

    • Advice or work in relation to divorce or children
    • Making an application to the court for financial remedy - for the court to determine the financial assets
    • Implementation of the consent order; e.g. conveyancing work
  • Stage 2: First Directions Appointment (FDA)

    At this stage, we will go through the following steps with you.

    1. Application

      Preparation of court application form

    2. Financial statement

      Update financial statement('Form E')

    3. Preparation of documents

      Preparation of questionnaire and first appointment documents

    4. Exchange

      Exchange of FDA documents

    5. Court

      Attend the FDA and representation you at court

    Not included in this package

    The following services are not included in this financial settlements package. We do offer these services separately.

    • Any advice in relation to children or divorce issues
    • Any other applications within the financial remedy application which may arise; e.g. an injunction to protect any assets that your spouse may have disposed of/ has the intention to dispose of
  • Stage 3: The Financial Dispute Resolution

    The intent is to encourage both parties to settle matters at the FDR stage without the need for matters to be contested to a final hearing.

    At the FDR hearing the judge will give an indication as to how he or she will determine the case if they were considering the matter at a final hearing.

    Confidentiality

    Also, offers made at a FDR hearing are kept confidential and cannot be referred to at a final hearing. However, most cases will be resolved during the FDR stage.

    At this stage, we will go through the following steps with you:

    1. Preparation

      Prepare your replies to the questionnaire and investigate spouses' questionnaire

    2. Instruction

      Instruction of experts

    3. Discussion

      Discuss proposals from your ex-partner (if any)

    4. Negotiation

      Negotiate an agreement and file the consent order at court

    5. FDR hearing

      If matters are not agreed we will attend the FDR hearing

    Not included in this package

  • Stage 4: The final hearing

    Occasionally, unfortunately matters do proceed to a final hearing.

    The final hearing is where control is taken away from each party and where the final decision is made by the judge.

    Both parties present their case through facts and evidence to this judge, who will then  give judgement as to how the financial assets will be divided.

    Final hearing process

    The process for the final hearing is complex and requires a lot of preparation.

    At this stage, we will go through the following steps with you.

    1. Update disclosure

      Update your financial disclosure

    2. Preparation

      Prepare narrative statements and bundles

    3. Cost estimates

      Update cost estimates

    4. Preparation of statement

      Prepare your open statement of proposals on your offer and prepare instructions to your barrister

    Not included in this package

    The following services are not included in this financial settlements package. We do offer these services separately.

    • Implementation of any terms of the consent order; e.g. any conveyancing work
    • Advice in respect of children and divorce matters
    • Financial advice; e.g. transfer of pensions in the event of a pension sharing order

Bespoke pricing packages

Gross capital below £350,000 Gross capital exceeds £350,000
The fixed fee service is available to couples whose total joint gross capital and income resources do not exceed £350,000. Furthermore all assets need to be based in England and Wales. When gross capital and income resources exceed £350,000 we offer clients bespoke packages. Due to the complexity of such cases our solicitors will spend more time effectively acting in your best interest.
