Visa application allowing you to join family in the UK
If you are joining a family member in the UK for more than six months, you will need to apply for a family visa.
There are several different categories of family visa, which apply to partners, parents and children. You can apply for a family visa from inside or outside the UK.
Joining your parent or parents in the UK
If you are a dependant child under the age of 18 you may be able to apply for a dependant visa and join your parents in the UK. You can join your parents if they are on a visa themselves or if they are residents or citizens of the UK.
If only one of your parents is currently living in the UK you can apply only if they are the sole surviving parent or if they have sole responsibility over your upbringing.
Visa application for joining your spouse, civil partner or fiancé
You can apply for a visa to join your spouse, civil partner or fiancé in the UK if:
- Your partner is a British citizen, or
- Your partner is settled in the UK with ‘indefinite leave to remain’, or
- Your partner has a refugee status in the UK, or
- Your partner has been giving humanitarian protection in the UK
What UK spouse visa are you eligible for?
There are different types of spouse visas. Which one you are eligible for will depend on your specific situation.
Typically, applicants apply using a ‘family of a settled person’ visa. You would be eligible for this visa if your partner is a British citizen, they hold indefinite leave to remain or if you are getting married and both intend to live in the UK.
If this type of visa is not applicable you may be able to apply for a fiancé visa, family reunion, EEA family permit or as the ‘dependant’ of a tier 2 or 4 visa, depending on your circumstances.
Visas allowing you to work and invest in the UK
If you are looking to move to the UK to work you may be able to apply for a ‘skilled workers‘ visa. To be able to apply for this type of visa you must pass a points-based assessment and in most cases you must have secured a job prior to arrival. However, if you are highly skilled, exceptionally talented, an investor or an entrepreneur you can apply for your visa without needing a job offer.
The points-based system has five separate tiers. If you wish to move to the UK to work you will likely either need a Tier 1 or Tier 2 visa. If you are staying in the UK for a short period only you may need to apply for a Tier 5 visa instead. The Tier 1 visa category is for high-value migrants and the Tier 2 visa category is for skilled workers.
To be eligible for one of these visas you must pass the points-based assessment as set out by the Home Office. Our solicitors can assess your application and circumstances beforehand and tell you how likely you will be to pass before you apply.
