  • If you are currently in the UK

    There is one important thing to know: you cannot apply for any of these visas while you are in the UK on a visitor visa. If you are in the UK currently on any other visa you can apply for a family visa from 28 days before your current visa expires.

    If you are in the UK currently on another visa you may be eligible to apply and switch into this category but must act before the expiry of your current visa.

  • Exceptional circumstances

    Some may not meet these criteria, however still be allowed to apply for this visa. Exceptions occur when:

    • The applicant has a child in the UK who is a British citizen. This child will need to have resided in the UK for at least seven years and be unlikely to leave
    • You are able to prove that you would encounter significant difficulties if you and your partner lived in a country other than the UK and that it would be unduly harsh if you were returned
    • It would be in breach of your human rights for your right to have a family and private life in the UK

Spouse, Fiance and Civil Partner Visas

If your partner is either a British citizen, is settled in the UK with ‘indefinite leave to remain’, has a refugee status or humanitarian protection from the UK, you may be able to apply for a visa to join them in the UK.

With these visas the applicant would be known as the ‘dependant’ and the spouse is known as the ‘sponsor’.

Before You Apply for your Visa

Before you apply, you will need to ensure you meet all the criteria for this type of visa.

You will need to be able to prove your relationship to your partner and prove that you both  have the intention to live together as partners and that the relationship is genuine in nature.

Proof of Your Relationship

In order to prove that you are in a genuine relationship with your partner you must provide evidence with your application.

You must be able to satisfy the Home Office that you have:

  • Been in a marriage or civil partnership, recognised by UK law, or
  • Been living together for at least two years at the time of application, in a relationship, or
  • You are engaged to marry or enter a civil partnership within six months of arrival in the UK

Furthermore, you will need to be able to prove that you have a good knowledge of the English language and that you can financially support yourself and any dependants.

To prove your English language ability you will likely need to complete the English language test.
