Who can make a fatal accident claim?

What does compensation cover?

Unlike most other claims for compensation, a fatal accident claim awards compensation in two parts:

The first amount takes into account the pain suffered by the deceased in the time between the accident and the time of death. This sum also covers funeral costs and any financial costs incurred during this time.

The second sum is calculated from the time of death and could compensate for the following:

  • Childcare costs
  • Cost of tasks or services performed by the deceased e.g. childcare, DIY and housework
  • Counselling services
  • Household expenses
  • Loss of benefits or pension rights
  • Loss of income to family dependents
  • Probate costs
  • Financial contributions

It also considers the financial contributions typically made by the deceased to take care of the family.
