Claiming Compensation for Fatal Accidents
Losing a loved one is devastating and learning to live with a passing is always extremely difficult.
In some cases you are able to prepare in some form for the loss of a close friend or relative. However, when you and your family have been struck by a sudden and unexpected loss from a fatal accident, you can feel like your whole world has collapsed.
How Compensation Can Help
No amount of compensation can recover your pain, but we hope that by handling your financial stresses you can take the time that you need to be with your family and grieve.
If a fatal accident has taken your loved one from you, AWH Solicitors can support and guide you through the process of claiming the compensation you require.
How to Claim Compensation after a Fatal Accident
We have set out who can make a fatal accident claim, what you will be awarded compensation for and how AWH Solicitors will manage your claim with our specialist no-win-no-fee legal service.
Who can make a fatal accident claim?
When you are financially dependent upon the deceased, their passing can be made even more traumatic.
By law, any of the following people are allowed to make a fatal accident claim:
- A wife or husband of the deceased, or former wife or husband
- A civil partner, or former civil partner
- A parent or ascendant
- A child or descendant, including non-blood related children such as step-children from marriage
- A brother, sister, aunt, or uncle
If you are unsure whether you fit into the legal allowances for a fatal accident claim, please don’t hesitate to get in touch with our team at AWH Solicitors who will gladly advise you.
What will compensation cover?
Unlike in most other claims for compensation, a fatal accident claim awards compensation in two parts:
The first amount will be with consideration of the pain suffered by the deceased in the time between the accident and the time of death. This initial compensation sum will also be based upon any financial costs during this time in addition to funeral costs.
The second sum is calculated from the time of death and could compensate for the following:
- Childcare costs
- Cost of tasks or services performed by the deceased e.g. childcare, DIY and housework
- Counselling services
- Household expenses
- Loss of benefits or pension rights
- Loss of income to family dependents
- Probate costs
It also considers the financial contributions typically made by the deceased to take care of the family.
Money seems nothing of importance compared to the people that you love, but we know that the compensation that you can be awarded will give some assistance and support helping you to start rebuilding your life.

Full transparency at all times
We aspire to be completely transparent on pricing from the beginning, so none of our clients will ever be surprised at the end of the process.
Furthermore, we believe advice and support from our team of solicitors should be affordable to those in need.
No win no fee and legal expenses
Our no win no fee solicitors in Manchester regularly assess the prospects of winning your case at all stages of your claim.
If we are able to offer you a Conditional Fee Agreement for your claim, you will not have to pay our legal costs, however, if you lose your claim you may have to pay your opponent’s legal costs.
Legal expenses insurance, which is often provided with some motor insurance policies, can be used to pay your opponent’s legal fees. To protect you, we take out a legal expenses insurance policy for you when taking on your no win, no fee claim, if you do not already have a policy.
Disbursements for legal costs
If you win, your opponent will pay the majority of your legal costs and disbursements.
Any legal costs which are not paid by your opponent may be deducted from your compensation. However, you will not pay anything if your claim is unsuccessful and not until it has come to the end.
Please be aware that cost may differ depending on your personal circumstances.
