What is Categorised as Food Poisoning?

Several different things can cause food poisoning if food is mishandled whilst it is being prepared. Restaurant food poisoning can happen if it is made in unsanitary conditions and can cause several different medical problems. Some of these could include:

  • Cryptosporidium
  • Rotavirus
  • Campylobacter

Symptoms of food poisoning include:

  • Feeling sick (nausea)
  • Being sick (vomiting)
  • Stomach cramps
  • A high temperature of 38C or higher
  • Experiencing body aches and chills
  • Diarrhoea

The period of time after you have eaten and in which you may experience these symptoms can vary. Sometimes they may start within a few days of eating the food, but they could also start a few hours afterwards or even a few weeks.

If you have fallen ill due to a low hygiene standard in a restaurant or cafe, then you can likely make a claim. In order to do this, you must be able to prove that the food was not safe and you have been ill due to the unsafe food.

Could Food Poisoning Cause Long-Term Health Problems?

In some food poisoning cases, there are examples of them causing more serious and long-lasting health problems. Irritable bowel syndrome (IBS) can develop from a case of food poisoning. IBS is a condition that affects the digestive system. It causes symptoms such as:

  • Stomach cramps
  • Bloating
  • Diarrhoea
  • Constipation

These symptoms tend to differ in severity but can sometimes last for days, weeks or months at a time. There’s no cure, but diet changes and medicines can often help control the symptoms. If you have developed IBS because of food poisoning, then you may be able to make a food poisoning claim.

How Should I be Protected from Food Poisoning?

It is widely recognised by governments that health and wellbeing are influenced by the wider physical environment. Therefore, the environmental health department of a country is responsible for maintaining food safety and standards to ensure a certain level of safety for their citizens. Whilst food allergies can’t always be reasonably accounted for, the risk of food poisoning from unsafe food is significantly diminished by these measures.

What is the Customer Protection Act 1987?

The Consumer Protection Act 1987 provides you with the right to claim compensation from the producer of the product if it has caused you a personal injury or if it has caused the death of a family member. This can include food that you may have eaten in a restaurant, and also food that you have purchased from a shop.
