Our whiplash claim process
1. Initial consultation
During your initial consultation we will assess if you can claim compensation for your whiplash injury and how we can support you.
2. Preparing documentation
This includes acquiring copies of medical reports, witness statements, receipts and photographs to strengthen your whiplash claim.
3. Assessing the impact of your injuries
We will then assess how your whiplash is likely to affect your life, both now and in the future. We will prepare a clear overview of what medical support should be taken into account when calculating your whiplash compensation. If your injury impacts your current or future earnings this will also be included in your compensation calculation.
4. Court representation
We settle most whiplash claims in favour of our clients before any hearings are necessary. It is rare, but in some cases court representation is required for your whiplash claim. If your case does go to court, we will be ready to represent you and argue on your behalf.
Claim compensation for your whiplash
Whiplash is the most common injury caused by road traffic accidents and despite what some people may say, it is a serious and deeply uncomfortable injury.
Since March 2018, reforms have been introduced with the aim of reducing whiplash compensation pay-outs and deterring fraudulent claims.
Fraudulent claims are unacceptable, however we fear that these reforms are discouraging genuine victims from taking legal action. As a consequence, we are even more determined to achieve justice for those who rightfully deserve it. If you are not sure where you stand with your whiplash injury claim, simply get in touch for some tailored advice.
What exactly is whiplash?
Whiplash is a type of neck injury caused by a sudden fast jolt forwards or backwards, and is common when cars collide on the road. This jolt causes the tendons or ligaments in the neck to sprain.
Because it is a form of soft tissue injury, the pain can become increasingly worse and even constant over time. In serious cases, whiplash can lead to fractures or even spinal injuries.
The symptoms of whiplash tend to only become obvious around six to twelve hours after the incident has occurred, and sometimes it can take days before the pain reaches its most severe.
Headaches, dizziness, memory loss and muscle spasms are all common symptoms of whiplash. Difficulty sleeping is also common. When coupled with constant discomfort, this can easily leave sufferers with other problems, like depression and stress.
When the symptoms last for six months or longer your condition would be classed as chronic whiplash or late whiplash syndrome. This understandably causes extreme pain and inconvenience.
Whiplash of this severity can have a drastic impact on the quality of your life.
How whiplash can occur
Car collisions are the most frequent cause of whiplash, particularly when the victim is in a stationary vehicle and another vehicle drives into the back of them. This causes the victim and their vehicle to jerk forward rapidly, with no time to brace for the impact.
Whiplash can also be caused by a heavy blow to the head or neck, fast theme park rides and contact sports, such as football or boxing.
We believe that no one should be left to deal with the painful, and expensive, consequences alone. If you have suffered a whiplash injury, compensation can help you get your life back in order.
How is whiplash compensation calculated?
As with every claim we handle, the amount of compensation you could be entitled to depends on the facts of your case. This includes the extent of your injuries, any loss of earnings and the costs you have incurred.
Generally speaking compensation pay-outs tend to be between £500 for minor injuries and up to tens of thousands of pounds for life-changing injuries. The average whiplash compensation we have seen awarded to our clients was around £2,500.
We will be clear about how much compensation you might receive from the word go and we will always work hard to get you the maximum possible figure.

Legal expenses insurance, which is often provided with some motor insurance policies, can be used to pay your opponent’s legal fees. To protect you, we take out a legal expenses insurance policy for you when taking on your no-win, no-fee claim, if you do not already have a policy.
Disbursements for legal costs
If you win, your opponent will pay the majority of your legal costs and disbursements.
Any legal costs which are not paid by your opponent may be deducted from your compensation. However, you will not pay anything if your claim is unsuccessful and not until it has come to the end.
