Whiplash Claims

Claim Compensation after an Accident

If you are suffering from whiplash because of an incident that was not your fault, you may be eligible to make claim compensation. We are experts in whiplash claims and are here for you.

All our personal injury and whiplash claims are handled on a no-win-no-fee basis, and all of the compensation awarded will go directly to you.

Whiplash Claim Process

  1. Initial consultation

In our initial consultation we will assess if you can claim compensation for your whiplash injury and how we can support you.
  2. Preparing documentation

This includes copies of medical reports, witness statements, receipts and photographs to strengthen your whiplash claim.
  3. Assess the impact of the injuries

We will assess how your whiplash will likely affect your life now, and in the future. We will prepare a clear overview of what medical support should be taken into account when calculating the whiplash compensation entitlement as well as other additional damages you may suffer.
  4. Court representation

We generally are able to settle these claims in favour of our client before any further hearings would become necessary, so only in some instances will you require court representation for your whiplash claim. However, if your case does go to court, we will be ready to argue your case and ensure you the best chance at a successful outcome.

Claim Compensation for Whiplash

Despite what some insurers and the media want you to believe, whiplash is a serious and deeply uncomfortable injury.

Since March 2018,  reforms have been introduced with the aim of reducing whiplash compensation pay-outs and deterring fraudulent claims.

We fear that these reforms are discouraging genuine victims from taking legal action, which makes us even more determined to achieve justice for those who rightfully deserve it.

  • What is whiplash?

Whiplash is a type of neck injury caused by a sudden fast jolt forwards or backwards, causing the tendons or ligaments in the neck to sprain.

As it is a form of soft tissue injury, the pain can become increasingly worse and constant over time for some people. In serious cases, whiplash can lead to fractures or spinal injuries.

  • Examples of when whiplash would occur

Car collisions are the most frequent cause of whiplash, particularly when the victim is in a stationary vehicle and another driver collides into the back of them, causing the vehicle in front and the victim’s upper body to jerk forward rapidly.

Whiplash can also be caused by a heavy blow to the head or neck, fast theme park rides and contact sports, such as football or boxing.

  • Spotting the signs of whiplash

It’s important to remember that the symptoms of whiplash tend to become obvious within six to twelve hours of the incident occurring, but sometimes it can take a matter of days before the pain becomes severe.

Headaches, dizziness, memory loss and muscle spasms are all common symptoms. Difficulty sleeping is also a common symptom of whiplash, which when coupled with constant discomfort, can leave sufferers with mood disorders such as depression.

When the symptoms last for six months or longer we speak of chronic whiplash or late whiplash syndrome and this tends to cause extreme pain and inconvenience. Whiplash of this severity can have a drastic impact on the quality of the victim’s life and we believe they should not be left to deal with the painful, and expensive, consequences alone.

  • The claim process

The process of claiming compensation for whiplash with AWH Solicitors is incredibly simple and you will not be charged any surprise or extortionate fees. All our personal injury claims are handled on a no-win-no-fee basis and you will be able to keep 100 percent of the compensation if your claim is successful.

After the initial consultation, your solicitor will help you to prepare the documentation required to present to the defendant, including copies of medical reports, witness statements, receipts and photographs in order to strengthen your case.

We will also assess how your injuries may impact life for you in the future and whether or not you will need ongoing treatment or modifications to help you get back to the way you where before the incident. The cost of any therapy, physiotherapy sessions or home mobility aids for example, will be taken into account when calculating your compensation entitlement.

Most of our personal injury cases are quickly settled in favour of our client without the need to go to court, but if your case does require court proceedings, we have the resources and experience to take it further. Through negotiation with the defendant, liability will be established and an agreement on how much compensation is owed will be finalised.

  • How is compensation calculated

Generally speaking, you could expect any possible compensation pay-out to be between £500 for claims involving minor injuries, up to tens of thousands of pounds for life-changing injuries. The average whiplash claim we win for clients has shown to be around £2,500.

As with every claim we handle, the amount of compensation you could be entitled to will significantly depend on the facts of your case, including the extent of your injuries, consequential loss of earnings and the costs you have incurred as a result.

From the initial consultation, will be upfront with you regarding the amount of compensation you could be eligible for and we will always work hard to secure the maximum figure on your behalf.

Our Fees

AWH Solicitors supports clients with their personal injury claims on a no-win-no-fee basis. This means that as a client, you won’t put yourself at any financial risk.

If your case isn’t successful you don’t pay a penny, and if you do win, then you will keep all of the compensation awarded.

We promise our clients 100 percent compensation and no hidden costs for successful injury claims.

Full transparency at all times

We aspire to be completely transparent on pricing from the beginning, so none of our clients will ever be surprised at the end of the process.

Furthermore, we believe advice and support from our team of solicitors should be affordable to those in need.

No win no fee and legal expenses

Our no win no fee solicitors in Manchester regularly assess the prospects of winning your case at all stages of your claim.

If we are able to offer you a Conditional Fee Agreement for your claim, you will not have to pay our legal costs, however, if you lose your claim you may have to pay your opponent’s legal costs.

Legal expenses insurance, which is often provided with some motor insurance policies, can be used to pay your opponent’s legal fees. To protect you, we take out a legal expenses insurance policy for you when taking on your no win, no fee claim, if you do not already have a policy.

Disbursements for legal costs

If you win, your opponent will pay the majority of your legal costs and disbursements.

Any legal costs which are not paid by your opponent may be deducted from your compensation. However, you will not pay anything if your claim is unsuccessful and not until it has come to the end.

Please be aware that cost may differ depending on your personal circumstances.
